Contract between you and Terceseht LLC

These Terms of Service ("Terms") are a legal agreement between you and Terceseht LLC ("VibeGo," "we," "us") governing your use of our iOS app, VS Code extension(s), websites, and related services (the "Services"). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility & Accounts

You must be at least 13 years old and capable of forming a binding contract. You are responsible for your account and for keeping your credentials secure.

2. License & Restrictions

We grant you a limited, non-exclusive, revocable license to use the Services for personal or internal business purposes. You may not: (a) reverse engineer, decompile, or attempt to access source code (except to the extent permitted by law); (b) interfere with security or access controls; (c) use the Services to infringe rights, distribute malware, or violate law; (d) attempt to bypass authentication, tunneling protections, or exposed-port policies.

3. Your Content & Remote Environments

You control the code and data in your own development environment. The Services act as a conduit to route your requests to your self-hosted or desktop-hosted tools (e.g., code-server). You are responsible for the content you process and for complying with applicable laws.

IDE Content. We do not intentionally collect or store the content you edit or view in your IDE. We design our systems so that IDE content is processed only as transient network traffic between your device and your remote environment, and not stored by us in a readable form. In limited situations (for example, when you ask us for support, when required by law, or when automated security systems detect abuse), we may temporarily handle or inspect traffic, but we do not build product features that ingest or index your source code. Network and security providers that route your traffic (for example, tunneling or hosting providers) may process data under their own terms and policies.

4. Software, Updates, and Third-Party Services

The Services may update automatically. Third-party services (e.g., Firebase/Google for auth, Cloudflare for tunneling, Apple IAP) are governed by their own terms and policies. We are not responsible for third-party services.

5. Subscriptions & Billing

If you purchase a paid plan or auto-renewing subscription, we will disclose the price, term, and renewal cadence before you pay. Subscriptions renew automatically until canceled. You can manage or cancel via Apple Subscriptions (iOS) or the account portal we provide. Fees are non-refundable except as required by law.

6. Acceptable Use

Do not use the Services to: (a) violate law; (b) infringe IP or privacy; (c) transmit malicious code; (d) attempt unauthorized access; (e) overload or interfere with the Services; (f) circumvent usage limits or session policies.

7. Ownership

We own the Services and all related IP. These Terms do not transfer any of our rights. You retain your rights in your content.

8. Feedback

If you provide feedback, you grant us a non-exclusive, worldwide, royalty-free license to use it to improve the Services.

9. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBEGO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNTS YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM.

11. Indemnification

You will defend and indemnify us from claims arising out of your use of the Services or violation of these Terms, except to the extent caused by our willful misconduct or violation of law.

12. Termination

You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or for security, legal, or operational reasons. On termination, Sections 7–13 survive.

13. DMCA

If you believe content infringes your copyright, see our DMCA Policy for instructions on sending a notice and counter-notice.

14. Changes

We may update these Terms. If we make material changes, we will notify you (e.g., in-app). Continued use after the effective date means you accept the changes.

15. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflicts rules. Any dispute will be resolved by binding arbitration administered by JAMS in Los Angeles County, CA, on an individual basis; class actions are waived. You and we may seek injunctive relief in court for IP or security misuse.
